The actual general conditions of use for Wanae services ( named “general conditions” as follows) are here to define the methods and conditions with which the user will be able to benefit from Wanae’s services proposed on the internet site www.wanae.com
By services, we mean and it is not limitated to hosting services, bringing out the content, the availability of tools like, opening pictures files and more generally, any other services offered by Wanae on the the address : http://www.wanae.com or any other addresses linked to that one. The services include all correspondence to the subscribers like administrative messages, the newsletter or the RSS flows.

Article 1- Agreement with the general conditions of use of Wanae services.

1.1    These services are only for persons, morally or physically, juridically able to subscribe to contracts in the interested country. The subscription to Wanae services is therefore the acceptance without any restrictions or reservations of the actual general conditions. Any use of these services implies by law the application of these general conditions.

1.2    If you are a minor, you must state that you have obtained your parents or tutors’ authorization in order to subscribe and to use Wanae services. Your parents or tutors agree to be responsible for the respect of all these actual  general conditions of use. Therefore, the parents or tutors have to check the use and access of the services by their children, keeping in mind that these services are intended for a wide public. Thus, they must know which services are appropriate or not for their children to check their use.

1.3    Wanae is a free exhibition, so the exhibitors and visitors are fully responsible of their relations that they would establish together via Wanae website. Exhibitors and visitors can exchange, exhibit, buy, sell their works how they want. Free from them to determine the transations conditions, and to take the usual precautions requested for the transactions. ALL the Laws in effect in your country MUST be respected (By-law, copyright...). The Exhibitor assumes the entire responsibility of its exhibition and also assumes the entire responsibility of selling its Works. Wanae has no responsibilities in case of dispute or disagreement regarding these actions.


Article 2- Subscription to wanae.com services.

2.1     When filling up the subscription form, you commit yourself to do it correctly and to provide accurate, complete and  up to date information. You must up  date them with any change of circomstance too. If not, Wanae has the right to terminate your account and block all access to its services and this, without any prejudice. Wanae can also refuse the access of its services without giving any reason.

2.2    You also commit yourself not to provide Wanae with an assumed name or an e-mail address that could harm a third party ( for example by using another person’s brand, family or assumed name, protected works or copyrights) whatever the reason. In these cases,Wanae has the right to refuse the subscription or to change the concerned name or address at anytime and before the subscription.

2.3      In order to activate your account and to confirm your subscription, you must click on the hypertext link within the e-mail that will be sent to you when the subscription with Wanae is done. This will be sent to the e-mail address you have indicated during subscription.

2.4    According to the regulation in force, the collected data when you subscribe are kept by Wanae as a proof of a contract and all communication. In case of  litigation between Wanae and the customer it is definitely Wanae’s data that would prevail over any other ones given by the customer.

2.5    Be aware that the data can be automatically used for statistics without any link being done between its use and your personal data. Wanae might be lead to use your personal data to optimize the access to all the services needed to subscribe. In addition, to provide you with promotional offers, we can give your data to commercial partners unless you say otherwise when you subscribe or at any time after. You can do it by clicking on the link that cancels the membership or in writing to Wanae at the address available on the contacts page. In the event that you still receive unsollicited promotional offers, please contact us.

Article 3- Description of Wanae services.

3.1     Wanae services are here to ease the steps of the user in his research about Art world and its contacts, like :
- Creation of an artistic profile with a photo book on line and the possibility to show works ( plastic or creative art). Personal details of the user are not shown but it is up to him to give them to a new contact.
- A news letter called “ Wanae News “ will be sent monthly.
- Entry to events in the Art network.
- Possibility to discuss and comment between members.
- Management of an interactive personal space.
- Management of the comments left by the net surfers.
- Auto-management for the exhibitor’s space.
The user is informed that such services are susceptible to change all the time and this may occur without any notice.

Article No 4 – Entry Codes : Uses and responsability

4.1    When you subscribe, you will have to choose personnel and confidential entry codes. This is to identify yourself and to allow a quick connection when using our services. You are then, fully responsible for the use and the confidentiality of these codes. Therefore, you are the only personresponsible for the use of your account, all connections and all data transfers done, using our services through your account, will be considered as being your sole responsibility. You are fully responsible too for the use of the services by yourself or third party.

4.2    In order to preserve the confidential and personal character of your entry, it is recommended to leave your account at the end of each session in clicking “disconnection” or a similar mention. In the event of a fraudulent use of your account or password, you must immediately inform Wanae.

4.3    The entry to our Services is only authorised or possible with the user name (login) and the password. The user commits himself to keep them solely confidential. Although the entry to the Services is the sole responsibility of the user, using his/her user name (login) and password, Wanae has the right to change the url addresses at any time with or without any notice. All entries to the Services are the considered take the sole responsibility of the user if done with his/her user name (login) and password.

4.4    In the event of the loss or the theft of the user name (login) and password, you must notify Wanaeas soon as possible and justify at that time your identity. Upon reception of your writing notification, Wanae will proceed to modify the user name (login) and password. In the meantime, the user remains responsible for the use of the Services that could be done with his/her user name (login) and password.

Article No 5 – General rules of ethical conduct

5.1    The Internet is a place of conviviality, where everyone should respect others. Besides the conditions of use stipulated within the General Conditions paragraph, you have to respect the following rules when using Wanae Services.

- ALL the Laws in force in your country MUST be respected, particularly the ones regarding the protection of young people, the protection of intellectual ownership and the protection of the status rights. (respect of the privacy of the third party, respect of the name, the image etc…)
- The Exhibitor assumes the entire responsibility of selling its Works
- The use of works protected by copyrights or similar works is forbidden without the explicit authorisation of the author or the holder of these works, it is clearly forbidden to propose the downloading or the copy of artistic works, other works or softwares protected by copyrights or similar rights without an explicit authorisation.

- It is forbidden to use Wanae Services to look at or to distribute some immoral or illegal contents.
- It is forbidden to use Wanae services for illegible purposes. It is also forbidden to pronounce or to broadcast  instructions to commit punishable acts.
- Interchanged Personal data ( like name, address, e-mail, telephone number )  have to be handled with confidentiality.
- In addition, it is forbidden to publish or to pronounce offensive, abusive, libelous, excessive, violent remarks or remarks leading to violence or obscene, racist, discriminative, pornographic, menacing remarks arousing discrimination or hate, with regards to race, religion, sex or anything else that could lead to crime or offense.
- It is forbidden to pardon any illegal act and it is forbidden to interfere with the smooth functioning of computing systems in any way. The relationship with other persons will have to be respectful and will have to take into consideration the cultural, ideological and religious differences; these should at all times be respected.
- It is forbidden to use Wanae services to broadcast promotional messages or any form of commercial advertising (or via links or telephone numbers), especially for other websites.
- The user must complete a saved copy of his contents. Wanae will not be responsible for the loss of data following a technical problem on the host or as a result of an illegal or malicious act on the site. Indeed, given the technical constraints of the internet, Wanae cannot be responsible for any malfunction of the service.
- It is forbidden :
- to do hacking, in any form;
- to spread viruses;
- to play with the services with scripts; any spamming is forbidden.
- to access or try to access another user’s (of the services) account;
- to hand over any promotional message not called upon or unauthorised;
- to usurp an identity, including that of an official Wanae representative or of a presenter or an administrator of the services;
- to harass in any way another or many other users of the services;
- to give information which refers to other sites (either by the creation of a hyperlink or the supply of information) from which content could conflict with all law and regulation in force, notably jeopardizing the persons rights and belongings or/and their intellectual property rights;
- to make statements that could harm Wanae;
- to harm in any way the image and reputation of Wanae;
- to collect, to stock, to disperse personal data of other users or third parties.
- As far as promotional games are concerned, an exhibitor cannot win a game twice within the same year.

Article No 6 – Authorised Content

6.1    The issued authorisation is managed according to the following principles:
The content you provide must be original and must not be under any exclusive rights that would prevent you from being issued the current authorisation.

6.2    Given their immaterial nature, the content files sent to Wanae will not be returned. You must make sure that the addressed files do not have any virus or similar programs.

6.3    In order to facilitate the best possible public exhibition of your content, you should hand over to Wanae all authorisation to enable the following tasks :
- The duplication of your content in full or partially. It’s integration and it’s communication to the public on Wanae.com or on their partner’s sites or on the sites with the Wanae’s name, with or without other texts and/or contents.
- The communication of your content using all communication vectors notably for nomad stools (like PDA or mobile phones).
- All commercial activity through all mediums is using all communication means in order to promote, advertise,  inform about Wanae’s activities, your content and/or your blog.
- The retention of the copy rights for the task as mentioned above.
- These authorisations are agreed by Wanae.

6.4    In addition, given the interactive nature of internet, you must be aware that your content can be presented within different contexts, associated, for example, to other works. It can also bring hyperlinks or partial commercial benefit. You must state that you accept this. The authorisations mentioned above allow the use of your content fully or partially.  

6.5    The authorisations mentioned above are provided free of charge, for the whole world because of the international nature of internet. This, for the entire period  of legal protection shall take effect from the starting date. However, you can terminate that authorisation for Wanae whenever you want to. You must be aware that commercial activity can lead to partnerships and/or can become an advertising medium for the advertisers. You must state your agreement on this too. The authorisation mentioned above is not exclusive.

6.6    Regarding pictures sent on Wanae, the user will guarantee he has the authorisation to hand them over to Wanae. For those which fully or partially represent a third party, the user guarantees that he has their or their tutors’ authorisation.

6.7    Therefore, the user will not be able to claim any right on his image and more generally, on the elements he gives to the site Wanae.com.

6.8     Thus, the user grants Wanae.com with a commercial license “ex gratia”, non- exclusive and all over the world. This is for the user’s elements to be exploited on the internet site, partners’ internet sites and more generally on all known or unknown supports on the day of the completion of the General Conditions, like paper, analogue support (tape, video tape), numeric support (cartridge, hard disk), wire, satellite, hertz and network, telecommunications network, internet, intranet, paper support, calendar flyers, invitation cards. All such content can be reproduced, represented, adapted, corrected etc.


Article No 7- Subscription and Access to Wanae services.

7.1    Wanae.com services are available according to the terms of  the subscription, only on line on an internet site with a free membership.

7.2    The user must then give all his personal details on the internet site and must specify a user name and a password in order to use the services. The user name and password are personal.

7.3    The user will become a member when he receives confirmation by e-mail of his membership to Wanae services, which will include the username and password so that he can connect to his membership space.

Article No 8 - Term of the services membership.

8.1    Wanae offers to the user a subscription to the services of Wanae.com site.
This subscription is free of charge.
The user must be aware that those services are likely to be continually updated and that they can be changed or cancelled at anytime and without any notice.
